Credit card swipe fee deal far from done

The lawsuit alleges MasterCard and Visa conspired with some of the largest banks in the country to set the swipe fee a merchant must pay every time a customer uses their credit card.

The final approval of a proposed multi-billion dollar legal settlement over credit card ?swipe fees? could be in jeopardy ? or at least delayed ? by more legal wrangling. Six of the 19 plaintiffs in the case, all big trade groups, now say they oppose the $7.25 billion deal reached in mid-July.?

The antitrust lawsuit, filed back in 2005, alleges MasterCard and Visa conspired with some of the largest banks in the country to set the swipe fee a merchant must pay every time a customer uses their credit card.? Customers don?t see that fee ? which ranges from 1.5 to 3.5 percent of the purchase ? even though we all pay for it in the form of higher prices.?

The banks and credit card companies say the fee is needed to pay for processing the transactions and to cover losses from fraud.? Merchants hate the swipe fee, saying it reduces their profits and forces them to raise prices.?

The six retail organizations who brought this case say they?re against the proposed agreement because it does not prevent Visa and MasterCard from boosting swipe fees whenever they want.?

?There is strong concern that the proposed settlement agreement will not achieve the litigation?s most critical goal ? to fundamentally change a broken marketplace in which swipe fees are set,? said Dawn Sweeney, president of the National Restaurant Association in a statement issued last week. ?Without meaningful reform, there is concern that restaurateurs ? many of who are small businesses ? will continue to be negatively impacted by the unfair, non-transparent system that exists today.??

The other plaintiffs who object to the proposed settlement: the National Association of Convenience Stores, National Grocers Association, National Community Pharmacists, National Cooperative Grocers Association and National Association of Truck Stop Operators.??

Thirteen other plaintiffs, mostly small stores, have not objected.?

The July agreement, believed to be the largest antitrust settlement in U.S. history, must still be approved by a federal district court judge in New York. It requires the defendants, MasterCard, Visa and more than a dozen banks to:?

  • Pay about $6 billion to be distributed to the millions of merchants represented in the lawsuit.
  • Roll back the credit card swipe fees for U.S. merchants for eight months. That would cost the credit card companies another $1.2 billion.
  • Give American retailers the ability to recover that interchange fee by charging customers who pay with Visa and MasterCard a ?checkout fee? ? where allowed by law ? equal to the interchange fee. Under the current Visa and MasterCard rules, retailers are not allowed to add such a surcharge.??

Visa called the settlement a ?fair and reasonable deal.? MasterCard noted that it represents ?a solution reached after years of litigation and months of negotiation.??

Trish Wexler, spokeswoman for the Electronic Payments Coalition (a group that represents credit card companies and banks) called the settlement ?the very best and most realistic outcome possible for all involved.??

In an email to NBC News.com, she wrote: ?After a long and thoughtful process that produced a fair compromise, these trade associations who helped to design this settlement are now trying to go back for seconds. Instead of accepting the benefits of the settlement, these groups want even more, and will clearly never be satisfied.??

Where to we go from here?
When the proposed settlement was announced three months ago, everyone considered it a done deal. But we?re not there yet. ?And the entire deal could be torpedoed or at least delayed by more legal action.?

A lawyer representing most of the trade groups opposed to the settlements plans to file a motion challenging the agreement. And the National Retail Federation (NRF) recently authorized its lawyers to go to court to block the settlement. The NRF, which is not a party to this lawsuit, represents thousands of merchants who would be affected by it.?

Mallory Duncan, the NRF?s senior vice president, told me the settlement is diametrically opposed to the goal of the lawsuit, ?to reign in those high, anti-competitive, hidden fees? which he said have been rising at an alarming rate.?

?It?s as if consumers said, ?Give us some relief,? and the card companies said, ?OK, we?ll shoot you, that will put you out of your misery,?? he said. ?If this settlement goes through, there is no limit to how high the swipe fees credit card companies and banks can impose.??

The world?s largest stores, Target and Walmart have also gone on record as opposed to the proposed settlement. Walmart said the agreement would not ?prohibit credit card networks from continually increasing hidden swipe fees, which already cost consumers tens of billions of dollars each year.??

It?s assumed federal judge John Gleeson will hold more hearings before he decides whether to give preliminary approval to the settlement early next year.?

Despite the pushback, Visa and MasterCard believe the settlement will be approved. So does Morgan Stanley. Although in a report issued last week, the company?s research department said it could take longer than expected for everything to be finalized.

?If the settlement is not approved, the Morgan Stanley report noted, this case could go to trial, something many of those involved in this lawsuit ? including judge Gleeson ? do not want,? they wrote.?

In the meantime, nothing changes. Retailers cannot impose a surcharge for using a Visa or MasterCard credit card ? and it?s not even certain very many would if they could. For example, Target and Walmart have both said such a fee is not in the customer?s best interest.?

In fact, ten states prohibit merchants from imposing a credit card surcharge fee: California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma and Texas. Morgan Stanley says these ten states represent 42 percent of retail sales in the U.S.?

There?s one other way this could all shake out, retailers could offer discounts for cash transactions ? if they want ? at any time. That?s something they can already do anywhere in the country.??

In the first five minutes of the strangely captivating and tastily quirky film Looper, we get a stage-setting sense of what?s to come. There stands our antihero (Joseph Gordon-Levitt) in a Kansas cornfield, gazing at his antique pocket watch and about to go to work with a well-aimed ?blunderbuss? gun. With this odd little howdy-do of a scene, we happily enter into the milieu of retro-futurist sci-fi and sense immediately that we?re in good cinematic hands, which we are, until the end. What we don?t know, apart from the central narrative conceit of the life of ?loopers? ? assassins, circa 2044, who off targets sent back in time from 30 years into a much darker, more dystopian future ? make for the film?s critical?twists.

Oh, and there is a certain love interest, in the fetching, kick-ass, and fearless parental protector form of Emily Blunt. Bruce Willis, meanwhile, is a more complicated bunch of characters, including a latter-day version of our young hero and someone with a serious score to settle, on a mission from the once-and-future future. Things get complex but never to the point of losing the primal theme at the core of the?film.

Looper is one of those rare films that plays well in the multiplex and exists in the outskirts of an artier film turf, warranting its coveted spot, for instance, as the opening film of last month?s Toronto International Film Festival. Writer-director Rian Johnson has cooked up a clever and internally logical time- and mind-warping scenario that relies less on CGI and future-scaping FX than on a kind of resourceful and hypnotic tale-spinning quality not so far removed from the realm of TV?s classic The Twilight Zone, another sci-fi source that accomplished a lot within a modest budget and technical means. Coincidentally or not, Looper?s plot includes a subplot directly linked to the famous Zone episode with evil young Billy Mumy uttering the words, ?You?re a bad man, you?re a very bad man? and sending evildoers into a figurative?cornfield.

From start to finish, Looper draws us into its peculiar and not exactly friendly world. The film already feels like it has earned its rightful place in the pantheon of cult classic retro-futurist cinema, alongside Blade Runner, Inception, and Repo Man, not to mention the imaginary art-pulpy worlds that Rod Serling hath?wrought.

Japan PM reshuffles his Cabinet to boost support

TOKYO (AP) ? Japanese Prime Minister Yoshihiko Noda reshuffled his Cabinet for the third time this year Monday in hopes of boosting flagging public support for his government amid speculation that elections will be called in coming months.

Noda appointed 10 new ministers in the 18-member Cabinet, saying the new lineup will tackle domestic and international issues facing the country and acknowledging that much remains to be done.

The most prominent changes include Koriki Jojima as finance minister, Seiji Maehara as national policy minister and Makiko Tanaka ? an outspoken lawmaker and one of Japan's most famous female politicians ? as education minister.

Eight Cabinet posts will not change hands, including key positions in charge of defense, foreign affairs and economics and trade.

"We will do our best to tackle the issues that are still halfway done, such as recovery from the (2011 tsunami) disaster, the battle to control the nuclear crisis and revival of the Japanese economy," Noda said at a press conference announcing the lineup.

Noda, in office for a year, has seen his support rating slide below 30 percent amid public discontent over his push to double the sales tax to 10 percent and general dismay with the ruling Democratic Party of Japan, which swept to power three years ago amid high hopes for change. But he handily won a party leadership vote last month.

He has said he would call elections "soon," but has given no timeframe, and lately has suggested he wants to remain in office to address Japan's various problems. Elections must be called by the summer of 2013 at the latest.

Polls show that voters prefer the main opposition party, the conservative Liberal Democratic Party, but many people are undecided.

Noda's government has been put under pressure by a territorial dispute with China over uninhabited islands in the East China Sea controlled by Japan but also claimed by China and Taiwan.

Russia is moving to draft legislation to combat an increase in foreign-sponsored espionage, while human rights organizations call for fairness.

Amid growing suspicions that foreign entities operating in Russian territory are working outside of their stated humanitarian aims, the country?s lawmakers are mulling laws intended to clamp down on the leaking of state secrets.

Yuri Gorbunov, Deputy Director of the Federal Security Service (FSB), encouraged lawmakers to pass the legislation to counter the changing nature of international espionage, which includes activities by non-governmental organizations (NGOs).

"It is important to include international organizations on the list of agents that can be charged with treason due to the fact that foreign intelligence agencies actively use them to camouflage their spying activity," Gorbunov said.

Following two more readings in parliament, the bill will be sent to President Putin for his signature.

The new amendments seek to remove any ambiguity of the current law from ?external security of the Russian Federation? to simply the ?security of the Russian Federation.?

According to Gorbunov, the former lacks a formal legal definition, whereas the latter is clearly defined.

The move to broaden Russia?s ability to battle foreign-sponsored espionage comes on the heels of an announcement that drew sharp criticism from the United States.

Last month, Russia ordered the closure of the United States Agency for International Development (USAID) ? which had operated in Russian since the collapse of the Soviet Union ? after concluding that the organization provided funds for NGOs seeking to "influence the political process, including elections at various levels and civil society."

Golos, an election-monitoring organization, is among the NGOs likely to be affected by the closure of USAID.

Many Russians claim a double standard in how foreign-funded organizations interfere in the country?s political affairs while, at the same time, Russia does not fund NGOs to monitor America?s election process.

As Russia bolsters its security and intelligence apparatuses, some warn that the initiatives should stay within the boundary of law. Human rights commissioner Vladimir Lukin argued that Russia?s law enforcement agencies need be careful to distinguish between having contact with foreigners and actual espionage.

"Naturally, I believe we should fight against espionage,? Lukin told reporters. ?Thank God, we have a very serious organization for battling this.?

The commissioner added, however, that he also supported ?a law-governed state, and, consequently, legal certainty." Russia can achieve that certainty by attempting to distinguish between genuine ?acts of espionage and contacts with foreign organizations,? Lukin said.

Such efforts will help to ?rule out arbitrariness,? he said. "Spies are normally embedded in the bodies that fight espionage, not in public organizations."
