Why the fiscal cliff is like getting a huge paycheck cut

As rival lawmakers struggle to avoid the dreaded fiscal cliff in Washington, research shows that Americans will get a huge cut in their take-home pay if Congress can?t reach a deal on tax hikes and spending cuts.

In basic terms, the fiscal cliff is a set of dramatic tax increases and government program spending cuts that would decrease the annual deficit run up by the federal government.

It was put into a debt-negotiation process by lawmakers as a ?poison pill,? an alternative so politically toxic that it would force Democrats and Republicans to agree, or face an angry mob of voters.

But an agreement was never reached in 2011, and now, the stark tax increases and spending cuts become law on January 1, 2013, unless a bipartisan agreement can be reached or the problem is pushed back into the hands of a new Congress.

The math behind the fiscal cliff can be quite complicated, but to see why politicians are scrambling to find a solution now, you only need to look at how the cliff would suck money out of voters? paychecks, if the fiscal cliff goes unchecked.

As a rule, Americans don?t like taxes, and they don?t like dramatic tax actions. Look back at the original Tea Party in Boston as an example.

A study from the Tax Policy Center, a joint venture of the Urban Institute and Brookings Institution, shows that tax hikes triggered by the cliff will ?dock the pay? of 90 percent of Americans.

?Taxes would rise by more than $500 billion in 2013?an average of almost $3,500 per household?as almost every tax cut enacted since 2001 would expire. Middle-income households would see an average increase of almost $2,000,? the group said in an October 2012 report.

The telling factor in the Center?s report is that after-tax income will fall in every tax bracket, at an average of 6.2 percent.

In other words, instead of getting a 6 percent raise in 2013, you?d have your take-home pay docked 6 percent, before your employer even had a chance to give you a raise.

About 40 million Americans in the lowest fifth of the economy would see take-home income fall 3.7 percent. Taxpayers in the top fifth of the economy would see a 7.7 percent drop. Middle income tax payers would see take-home income fall by 4.4 percent.

Fiscal Cliff Changes in Take-Home Pay

Percent Dollars
Lowest quintile -3.7% $??????? 412
Second quintile -4.5% $??? 1,231
Middle quintile -4.4% $??? 1,984
Fourth quintile -5.1% $??? 3,540
Top quintile -7.7% $? 14,173

Average -6.2% $??? 3,446

The tax changes hit Americans from all angles. The biggest hit is from the expiration of the Bush-era tax cuts, but there are also Obama-era tax cuts and credits that expire.

There will be tax penalties for married couples and for families with children. And the dreaded Alternative Minimum Tax is in the mix, which would increase taxes for 22 million people.

So income taxes would go up, payroll taxes would go up, and estate taxes and dividend taxes would go up.

And there is a new tax to pay for the Affordable Care Act.

If there is a silver lining, the federal government would bring in an extra $536 billion in 2013 to use for deficit reduction. About 54 percent of that money would come from ending the Bush-era tax cuts and from new payroll taxes.

The health-care tax would take up about 5 percent of the overall tax hikes.

To get a different look at how the tax changes would affect your family, the Tax Foundation has an online calculator that lets you put in your income and deductions and see your actual tax hike under different scenarios.

Recent Constitution Daily Stories

More states ponder legal marijuana as feds loom
The Klan?s indirect role in fostering the Jazz Age
Constitution Check: Can a judge send a criminal to church instead of prison?

The Foundation has its critics, which say it is a conservative-leaning group.

But when we added data from the calculator on a married couple, with two children, making $60,000 annually, the tax-home pay number was similar to the information from the Tax Policy Center.

In most middle-income scenarios, the Foundation calculator shows take-home income falling by about 5 percent.

Its calculator also lets you pick different scenarios for dependents and dropping the Alternative Minimum Tax.

For now, President Obama and House leader John Boehner aren?t speaking, and the Democrats and Republicans are presenting the tax and spending plans to Americans, in advance of a big congressional showdown in December.

Obama is committed to extending tax cuts for the middle class and hiking taxes on wealthier citizens. The GOP is committed to deep spending cuts in ?entitlement? programs as part of any fiscal cliff bargain, which would include sparse tax hikes.

The most anxious watchers are Wall Street and its partners in the global economy, which are very much aware of Congressional Budget Office projections of a 2013 recession if the fiscal cliff goes into effect.

CafePress

Small businesses and promotional designers have long known CafePress.com as the go-to site for making (and also selling) customized goods, everything from logo coffee mugs to rock band baby t-shirts. Around the holidays, individuals might use CafePress to design custom holiday greeting cards, or make a photo wall calendar. But is it any better, faster, or cheaper than other sites that offer the same service, such as Snapfish, Zazzle, or Editors' Choice Mixbook?

In my experience, CafePress has a good and reliable service, that's even better if you have a designer on hand to create a final image with professional tools, like Photoshop or Illustrator. If all you need to do is drop a logo or pre-made image on a product and bulk order 50 of them for your employees or customers, the service is fast and efficient. But those of us who need a lot of guidance when laying out our own goods might find CafePress' designing and editing tools lacking.

For the purpose of this review, we chose not to evaluate CafePress on its marketplace capabilities, but readers should note that CafePress does allow users to sell their creations through the site.

Sizes, Styles, and Price
I'd been evaluating a variety of services for making photo wall calendars, when CafePress came to mind. Indeed, the site isn't limited to businesses buying customized products in bulk by any stretch. You can design and purchase a single wall calendar, or mug, t-shirt, sweatshirt, iPhone case, and dozens of other products, too.

The number of templates for custom calendars seems modest when compared with Mixbook's dozens of options. The editing tools for calendars and mug and glassware designing, likewise, didn't further my own creativity to any significant degree. T-shirts and other wearables get special treatment, though, with additional tools for adding text, changing the font, and dropping in shapes (graphic objects, like stars, hearts, and arrow). But even clothes design comes with a barrel of restrictions.? You can't change the dimensions or placement of images, as each product has its own specific placement and size for images. This also means you can't add more images, like a brand image and a company logo. Any creative work really needs to happen offline in a separate editing program. CafePress doesn't have the tools an amateur would need to actually create a design she had in mind.

For photo wall calendars, CafePress does include one "template" that's nothing more than a blank canvas, letting you set images that take up the entire 8.5 by 11-inch space. Unfortunately, calendars only come in the one size, although you can buy either a 12-month ($19.99 plus shipping) or 18-month ($24.99 plus shipping) version. Mixbook, our Editors' Choice for making calendars, offers a wider 11 by 14-inch landscape calendar option ($34.99) if you're looking to super-size it.

15 Types Of Workers Living Off Tips

Shelling out a tip might not seem like a big deal to you, but to many workers, it makes a world of difference.

Take waiters. More than half of their income on average comes from tips, according to a new study by PayScale, a website that analyzes compensation data. And they're not alone, with bartenders, valets and, yes, exotic dancers not far behind.

Lots of people don't really care. In fact, 39 percent of Americans didn't give a holiday tip last December, according to a survey by the Consumer Reports National Research Center. The most common reason given for skipping holiday tipping? A tight budget.

Of course, not everyone is equally likely to get a tip, and the survey found it's housecleaners that were most likely to receive a couple extra holiday bucks last year -- perhaps a tad ironically, given that they don't rely on them much.

Check out the types of workers that rely the most on tips below:

Embracing data 'noise' brings Greenland's complex ice melt into focus

ScienceDaily (Nov. 27, 2012) ? An enhanced approach to capturing changes on Earth's surface via satellite could provide a more accurate account of how ice sheets, river basins and other geographic areas are changing as a result of natural and human factors. In a first application, the technique revealed sharper-than-ever details about Greenland's massive ice sheet, including that the rate at which it is melting might be accelerating more slowly than predicted.

Princeton University researchers developed a mathematical framework and a computer code to accurately capture ground-level conditions collected on particular geographic regions by the GRACE satellites (Gravity Recovery And Climate Experiment), according to a report in the Proceedings of the National Academy of Sciences. A joint project of NASA and the German Aerospace Center, GRACE measures gravity to depict how mass such as ice or water is distributed over Earth's surface. A change in GRACE data can signify a change in mass, such as a receding glacier.

Typically, GRACE data are recorded for the whole globe and processed to remove large regional differences, said lead author Christopher Harig, a postdoctoral research associate in Princeton's Department of Geosciences. The result is a coarse image that can provide a general sense of mass change, but not details such as various mass fluctuations within an area.

With their method, Harig and co-author Frederik Simons, an assistant professor of geosciences, can clean up data "noise" -- the signal variations and distortions that can obscure satellite readings -- and then recover the finer surface details hidden within. From this, they can configure regional information into a high-resolution map that depicts the specific areas where mass change is happening and to what degree.

"We try to do very little processing to the data and stay closer to the real signal," Simons said. "GRACE data contain a lot of signals and a lot of noise. Our technique learns enough about the noise to effectively recover the signal, and at much finer spatial scales than was possible before. We can 'see through' the noise and recover the 'true' geophysical information contained in these data. We can now revisit GRACE data related to areas such as river basins and irrigation and soil moisture, not just ice sheets."

The researchers tested their method on GRACE data for Greenland recorded from 2003 to 2010 and brought the complexities of the island's glaciers into clearer focus. While overall ice loss on Greenland consistently increased between 2003 and 2010, Harig and Simons found that it was in fact very patchy from region to region.

In addition, the enhanced detail of where and how much ice melted allowed the researchers to estimate that the annual acceleration in ice loss is much lower than previous research has suggested, roughly increasing by 8 billion tons every year. Previous estimates were as high as 30 billion tons more per year.

Douglas MacAyeal, a geophysical sciences professor at the University of Chicago, said that the research provides a standardized and accurate method for translating GRACE data, particularly for ice sheets. The sprawling, incomplete nature of the satellite's information has spawned a myriad of approaches to interpreting it, some unique to specific scientists, he said.

"GRACE data is notoriously noisy and spatially spread out, and this has resulted in 'ad hoc' methods for processing mass changes of Earth's ice sheets that have wildly different values," said MacAyeal, who is familiar with the Princeton work but had no role in it.

"In other words, each particular investigator ends up getting a different individual number for the net change in mass," he said. "What this research does is figure out a way to be more thoughtful and purposeful about exactly how to deal with GRACE's notorieties. This method would allow researchers to standardize a bit more and also to understand more precisely where they are, and where they are not, able to resolve ice changes."

Simons compared the noise that previously obscured a precise view of Greenland's glaciers to fog on a window. For a small area such as Greenland, the GRACE signal can be easily overwhelmed by noise, which has numerous causes such as the satellite's orbital position or even the type of mathematics researchers use to interpret data, Simons said.

"Other researchers used less than perfect tools to wipe off the window more or less indiscriminately and quite literally left streaks on the data. They were thus less able to put the continent into the proper focus," he said.

"We effectively modeled then removed noise to get the ice-loss signal out of the data," Simons said. "We then recovered relatively tiny variations in ice mass that to others might have looked like noise, but that to us were shown to be signal."

The Princeton researchers found that Greenland lost roughly 200 billion tons of ice each year during the seven-year period studied, which falls within the range reported by other studies. The amount of ice lost annually could stack up on all of Manhattan to nearly 12,000 feet, or more than eight times taller than the Empire State Building, Harig said.

As expected, ice loss occurred in the lower, warmer coastal areas -- as opposed to the higher and colder interior, which gained ice mass -- but the melt was concentrated on the southeast and northwest coasts for most of the period studied. Indeed, many coastal areas showed no ice-mass loss, while the ice sheet on the southwest coast actually thickened slightly from 2003 to 2006.

But these trends were more complex when Harig and Simons got into the details. Surprisingly, the location of the greatest melt activity migrated around the island, shifting from the southeast to the northwest coast in just a few years. Ice loss on the southeast coast built up starting in 2003 and hit a highpoint in 2007. In 2008, loss on this coast began to recede and shift toward the northwest coast; by 2010, the southeast coast displayed only minor ice loss, while nearly the entire western coast exhibited the most severe melt. During this transition, melt also receded then picked up again on the northeastern coast with seemingly little overlap with activity elsewhere.

Details such as these can help scientists better understand the interplay between Greenland's glaciers and factors that influence melt such as ocean temperature, daily sunshine and cloud coverage, Harig said. That understanding can in turn help researchers determine how the Greenland ice sheet responds to climate change -- and how much more ice loss to expect. At current melt rates, the Greenland ice sheet would take about 13,000 years to melt completely, which would result in a global sea-level rise of more than 21 feet (6.5 meters), Harig said.

"Scientists are not totally sure what the driving force of the melt on Greenland is on short, yearly timescales," Harig said. "There is no certainty about which outside factor is the most important or if all of them contribute. Being able to compare what is happening regionally to field observations from other researchers of what a glacier is doing helps us figure out what is causing all this melt."

Michael Oppenheimer, Princeton's Albert G. Milbank Professor of Geosciences and International Affairs, said that the new level of detail Harig and Simons provide on Greenland's glaciers not only gives insight into what is causing the glaciers to melt, but what could possibly happen if they do.

Unlike water in a bathtub, sea-level rise is not uniform, said Oppenheimer, who is familiar with the research but had no role in it. Higher waters in certain locations may depend on which part of an ice sheet melts, he said. And determining which part of an ice sheet is melting the most requires precise details of ice loss and gain for specific glaciers -- details that have largely been unavailable, Oppenheimer said.

"Nobody has really been able to take a look at an individual ice sheet and determine the influence that ice loss from different parts of that ice sheet could have on sea levels," Oppenheimer said.

"The details matter. Being able to pinpoint where and how much ice gain and loss there is tells you something about the driving forces behind it, and therefore how much we can expect in the future," he said. "A synoptic view at a high resolution is what GRACE always promised, and now this research has helped realize that potential. It's time to finally milk the data for as much detail as possible."

Harig is adapting the computer code -- which is available online -- to study GRACE data on ice loss in Antarctica and water accumulation in the Amazon River basin.

The paper, "Mapping Greenland's mass loss in space and time," was published online Nov. 19 in the Proceedings of the National Academy of Sciences. It was supported by a grant from the National Science Foundation.

The Bankruptcy Tips You Need To Know Right Now | Siben & Siben ...

TIP! Before declaring bankruptcy, ensure that all other options have been considered. If your debt is relatively low, you may be able to manage it with credit counseling.

It can be a complicated process to file for personal bankruptcy. There are a number of kinds of bankruptcy. The type that applies to you will be chosen based upon the type of debts you have. Research into what will best suit you is important before you consider filing. The below advice can assist you in beginning.

TIP! If you have fears that you will lose your car, ask your lawyer about the possibility of lowering your car payments. Most of the time Chapter 7 bankruptcy will allow your payments to be lowered.

If you are filing for chapter seven bankruptcy, the dismissal of the balance of your debts is not a given. Secured debt obligations may require you to reaffirm them with the creditor, and other debts may not be dischargeable at all. For example, child support payments, alimony and other court-related fines cannot be discharged by filing for Chapter 7.

TIP! Familiarize yourself with any new law before you make the final step to filing for bankruptcy. These kinds of laws are constantly changing and it is important that you are aware of these changes, so that you can learn how to properly file for bankruptcy.

You should check with the personal bankruptcy resources available online to educate yourself thoroughly before you begin the process. The United States DOJ, along with a number of other bankruptcy institutes and attorneys specializing in bankruptcy can give you invaluable information. The more you know about it, the better you are able to make the best decision for your situation and to make sure that the bankruptcy proceedings move forward with minimal setbacks.

TIP! Don?t wait till it?s too late to file for bankruptcy. The judge reviewing your petition will consider your recent behavior, purchases, income and payments when making a decision.

Be certain you are totally aware of the laws of bankruptcy before you file. For instance, you need to know not to shift assets into someone else?s name in the year leading up to your filing. Not only that, but the filer cannot lawfully accrue additional debt just prior to filing.

TIP! Double check the accuracy of your information. It is fine for your attorney to complete the papers for you, but it is ultimately up to you to make sure the information contained is correct.

About two months after you?ve done bankruptcy, you can get copies of your various credit reports from the three agencies. Scrutinize the information, and make sure all debts that should be discharged are and that all of your previous credit accounts are closed. You want to start building up your credit score from an accurate base, so it?s important to address any errors you find in your reports immediately.

TIP! Look over your debts before filing for bankruptcy to make sure they will clear your credit report, as you would not want to file unnecessarily. Certain debts, including student loans, may remain with you regardless of your bankruptcy filing.

Even if you start a new job prior to declaring bankruptcy, do not change your plans! Bankruptcy may still be right for you. Choosing to file can impact you well. If your case is filed before you begin your new job, any repayment you must do will be calculated without the extra income.

TIP! While you should trust your lawyer, you should not leave all the details to your lawyer?s discretion. Your attorney is a professional who knows about laws regarding bankruptcy, but you should still know as much as you can about the proceedings.

If you?ve filed for Chapter 13 bankruptcy, accelerate your repayment schedule by paying more the the minimum amount each month. A lot of people only make the smallest payments possible, thinking that it?s the most comfortable way, but it can put them in danger of getting into debt quickly.

TIP! If you are feeling like you are seriously going to have to file for bankruptcy then do not clear out your savings. Retirement accounts should never be accessed unless all other options have been exhausted.

Many people believe that filing for bankruptcy will ruin their financial future, which will prevent them from getting loans. In some cases, this might be true, but in others, your credit score may actually end up higher post-bankruptcy than it was pre-bankruptcy. It is essential to continue making timely payments in order to rebuild credit.

TIP! A good piece of advice when filing for bankruptcy is to prepare yourself just in case you get denied. If you are prepared ahead of time, you can have an easier time anticipating what might happen if denial happens, which could result in foreclosure or repossessions.

Don?t use credit cards to pay your taxes if you?re going to file bankruptcy. In most states, you will still owe money to the IRS and have to take care of the interest of your credit cards. In most cases, you can use the adage that ?a dischargeable tax is a dischargeable debt.? So, in short, do not use your credit cards to pay off debts right before you file for bankruptcy.

TIP! Don?t avoid telling your lawyer specific details with your case. Never assume that they can remember all details without reminders.

If you plan to file bankruptcy, do not continue using credit cards. You might be tempted to max out your credit cards, but remember that the court will not approve of this. Try to be as financially conservative as possible. Now is the perfect time to work on developing excellent financial habits.

TIP! Keep working to improve your situation. When you file for bankruptcy you may be allowed to recover property like your car, electronics or jewelry that might have been repossessed.

You likely now understand that bankruptcy is something that should be undertaken carefully and with great deliberation. With your finances in turmoil, seek a reputable attorney who has bankruptcy experience. This will allow you to see this as a true, fresh experience

Excitement over holiday parade could prelude community turnaround

?

The Whitehaven Christmas Parade kicked off the holiday season on the heels of tree lighting ceremonies all over town last night.

Some say the high turnout Saturday could be a prelude to a community turnaround.

The sound of drums, horns, and cheers drew five thousand revelers to the Whitehaven Christmas Parade from all over Memphis.

"The biggest turnout ever. ?What a great sun shiny day," said Whitehaven Christmas Parade Organizer Hazel Moore. Watch video of the parade here.?

Preventive screening for sudden cardiac death in young athletes debated

ScienceDaily (Nov. 26, 2012) ? While ensuring the safety of high school and college athletes is hardly controversial, the method and associated costs of doing so are hotly debated. Conducting electrocardiographic (ECG) screenings of all young competitive athletes in the United States would cost up to $69 billion over 20 years and save about 4,813 lives, making the cost per life saved over $10 million, according to a study published online November 27 in the Journal of the American College of Cardiology.

A corresponding editorial suggests that this number is inflated and "misleading" and blames the high costs on cultural attitudes and medical policies on preventative medicine in the United States. The issue has been widely debated among experts currently in sports cardiology, a growing field of medicine in the United States. The European Society of Cardiology recommends mandatory ECG screening of all competitive athletes, but the American Heart Association recommends a physical exam and family history questionnaire as a first-line screening, with further examination based on the results of those initial steps.

"While this research focuses on the monetary costs of mandatory ECG screening, it is important to consider the human costs of false positives, which can result in additional potentially unnecessary tests and removal from play of athletes who are not actually at risk," said ACC President William Zoghbi, MD, FACC. "Most in this discussion agree that physicals, thorough family histories, targeted testing with ECG and other modalities when needed, widespread training in CPR, and availability of automated external defibrillators save lives from sudden cardiac arrest."

A 2006 Italian observational study found that mandatory ECG-based screening of athletes implemented by Italian law led, over a 20-year period, to a 89 percent relative risk reduction in sudden cardiac death; however, the absolute risk reduction, the cost and the economic ramifications have not been addressed in this study.

Researchers in the current study established a cost-projection model based on the Italian study to estimate the number of athletes who would need to undergo screening if it were required in the U.S., compute the costs and determine the number of lives that could be saved. The number of screening-eligible athletes was estimated from data provided by the National Collegiate Athletic Association and the National Federation of State High School Associations and diagnostic test costs were determined from Medicare reimbursement rates.

Based on this data, researchers determined that 8.5 million athletes would undergo annual ECG screening over 20 years, with 2 percent ultimately disqualified as a result of follow up screenings each year. That equates to 170 million screening tests and 3.4 million disqualifications over two decades.

The number of athletes disqualified for heart conditions would cause the sudden cardiac death rate to decrease from 4 to 0.43 per 100,000, but the costs would be in the billions. Researchers estimate that 20 years of testing would cost between $51 billion and $69 billion and save about 4,813 lives, which averages to between $10.6 million and $14.4 million per life saved.

Antonio Pelliccia, MD, of the Institute of Sport Medicine and Science in Rome, disagrees with the conclusions of the study. He argues the study overestimates costs because the screenings are part of a preventative program that targets young people who are for the most part healthy, is conducted outside of hospitals and is performed by team physicians, not cardiologists. Screenings would be packaged as a unique medical procedure instead of priced as individual diagnostic tests.

He acknowledges that reimbursement of pre-participation screenings as a preventative medicine program does not currently exist in the Medicare system and this "represents a major obstacle" in implementing ECG-based pre-participation screening.

According to Dr. Pelliccia, in Italy where ECG screening is mandatory for athletes, the cost is about $60 per athlete, including history, physical and 12-lead ECG, which is a price based on an agreement between the Board of Sport Physicians and the Italian government. The National Health System also refunds this fee for low income individuals.

He said the obstacles in the United States are not economic but cultural and "will require a change in the cultural attitude and current medical policy in the United States, where preventative medicine programs are unlikely to be federally supported."

Palestinians predict historic UN vote on statehood

UNITED NATIONS (AP) ? The Palestinians predicted a historic U.N. vote recognizing their statehood this week, praising important new support from France on Tuesday and likely backing from other European nations seen as critical to enhancing their international standing.

The United States and Israel strongly oppose the resolution, and there are fears it could torpedo Palestinian hopes of quickly resuming negotiations with Israel to end their decades-old conflict. Israeli officials have already said they will not return to negotiations after the vote and believe it instead undermines hopes for a peace deal.

The General Assembly vote to raise the Palestinians' status from a U.N. observer to a nonmember observer state is scheduled for Thursday ? the "International Day of Solidarity with the Palestinian People" ? just a week after a cease-fire ended eight days of punishing Israeli airstrikes on the Gaza Strip and intense rocketing of the Jewish state by Gaza's Hamas rulers that reached Jerusalem and Tel Aviv.

Unlike the Security Council, there are no vetoes in the General Assembly and the resolution is virtually certain of approval. The 193-member world body is dominated by countries sympathetic to the Palestinian cause and the resolution only requires a majority vote for approval.

The U.N. recognition of their statehood would elevate the Palestinians to the same status as the Vatican, another nonmember observer state. However, a country's vote to raise the Palestinian status at the U.N. does not imply its individual recognition of a Palestinian state, something that must be done bilaterally. To date, 132 countries ? over two-thirds of the U.N. member states ? have recognized the state of Palestine.

The U.N. recognition, however, would add weight Palestinian claims for a state in the West Bank, Gaza Strip and east Jerusalem, territories captured by Israel in the 1967 Mideast war. Israel pulled out of Gaza in 2005.

The vote is taking place while the Palestinians themselves remain bitterly divided: Hamas, which does not recognize Israel's right to exist, claimed victory in the recent conflict and raised its standing in the Arab world, while the rival Fatah movement of President Mahmoud Abbas, which controls the West Bank, remained sidelined.

Abbas needs a solid vote in the General Assembly to strengthen his domestic position and he is flying to New York to present the case for U.N. recognition of the state of Palestine.

Riyad Mansour, the Palestinian U.N. observer, said the final draft resolution, which was only circulated to U.N. members late Monday, has close to 60 cosponsors and he expects more by the time of the vote.

"I think that the great majority of nations will vote with us because there is a global consensus on the two-state solution" that envisions Palestine and Israel living side-by-side in peace, Mansour said at a news conference. "So we expect a large number of countries to vote in favor."

The Palestinians have focused much attention on getting support from European nations because of the clout that their backing would give to Palestinian statehood dream. France came through Tuesday when Foreign Minister Laurent Fabius told Parliament in Paris that the country will vote "yes" on the resolution.

"We tried very hard to win the largest number of European countries to vote in favor," Mansour said. "We are delighted that a certain number have declared their support to our draft resolution including France and other key European countries, and I don't want to name them."

Portugal will also vote yes and Switzerland will likely back the resolution, but Germany is expected to vote no or abstain. Britain's position remains unclear.

Australian Prime Minister Julia Gillard announced in a statement Tuesday that her country will abstain.

Mansour said approval of the resolution will be "a historic moment" for the Palestinian people and for the United Nations.

The Palestinians are seeking to enhance their status because their application in September 2011 to become a full U.N. member state has been blocked. To become a member state, an applicant must be approved by the U.N. Security Council and the United States has made clear it would veto the bid until there is a final settlement with Israel.

Abbas' spokesman Nabil Abu Redeineh told AP on Tuesday that there was pressure "around the clock from all sides in order to prevent us going to the General Assembly."

But he said the move toward statehood would not be reversed and adoption of the resolution would be "a major turning point in the Palestinian-Israeli track and ... a Palestinian and Arab achievement."

The Palestinians hope to use their upgraded status to join additional U.N. bodies, such as the International Criminal Court, where they could attempt to prosecute Israel for war crimes or crimes against humanity.

The draft resolution makes no mention of the ICC. U.N. diplomats said the issue was raised during discussions with the Palestinians by some governments. Israel reportedly wanted to include assurances that the Palestinians won't go to the ICC, and that the resolution does not infringe on sovereignty, but these amendments were rejected.

Mansour told reporters the Palestinians' top priority is resuming negotiations and not going to the ICC.

"I believe that the day after we adopt the resolution, if the other side is ready and willing to negotiate in good faith with us, I believe that the Palestinian leadership would reciprocate in a positive way," he said.

"I don't believe that we are going to be rushing the second day to join everything related to the United Nations, including to the ICC," Mansour said.

He said if Israel acts in good faith, according to international law, "I don't think that anybody will be going after them for anything."

But if Israel continues to violate the law, refuses to comply with U.N. resolutions and keeps building settlements, he said, the Palestinians will look at other options to bring them into compliance.

Following last year's move by the Palestinians to join the U.N. cultural agency UNESCO, the United States withheld funds from the organization, which amount to 22 percent of its budget. The U.S. also withheld money to the Palestinians, and the U.S. Congress has threatened similar sanctions if the Palestinians improve their status at the U.N. again.

Israel also retaliated by accelerating settlement construction and withholding funds from the Palestinian government.

Mansour said he is sure Abbas will try everything possible to avoid any punishment after the vote, but if "some negative things are going to be imposed on us we will deal with them in the best way that we know how."

He also expressed hope that the resolution will improve prospects for reconciliation between Hamas and Fatah.

Asked whether Hamas supports a two-state solution, which would imply recognition of Israel, Mansour said "I think they would ? yes ? because it is in the interest of the Palestinian people."

Russia's punk band spurn chance to cash in on fame

MOSCOW (Reuters) - Two members of the Russian feminist punk protest band Pussy Riot are sitting in jail for protesting in a church against Vladimir Putin.

Meanwhile, for $19.95, plus shipping, fans of the U.S. singer Madonna can order a 100 percent cotton "Pussy Riot" T-shirt, featuring the band's logo of a woman in a red mini dress and ski mask, with a raised fist and an electric guitar.

First came the battle for freedom, now comes the battle for merchandise. Three months after the end of a trial that shot them to world fame, band members say they are fighting to stop anyone cashing on its multi-million-dollar brand.

Experts say the Pussy Riot name is worth a fortune. If they were interested, the band's members could get rich from tours, films, documentaries and recording contracts.

But it is anathema to the women who, dressed in garish masks, dresses and mismatched tights, burst into a Russian Orthodox cathedral last February and performed a "punk prayer" calling for the Virgin Mary to chase away Putin.

"We will never allow the brand to be registered," said Yekaterina Samutsevich, the only one of three jailed band members so far to go free, who announced on her release that she will represent the interests of the two still in prison.

"We've always said our band would never be commercial. To an extent it was created to fight commercialism."

MATERIAL HELP FROM THE MATERIAL GIRL

Samutsevich, 30, was convicted in August of hooliganism motivated by religious hatred, along with Nadezhda Tolokonnikova, 23, and Maria Alyokhina, 24.

Samutsevich's sentence was suspended and she was freed on appeal; Tolokonnikova and Alyokhina have started two-year jail terms. Amnesty International calls them prisoners of conscience.

The band is now so well known in the West that a character wore a T-shirt saying "Free Pussy Riot" in a recent episode of South Park, an American animated sitcom.

"Over the next two years the brand could feasibly generate over $3 million in gross revenue, with a net income of around $2-2.5 million," estimated Kevin Drost, engagement manager for marketing consultancy Prophet Brand Strategy. He cited potential revenue from touring, merchandise, digital sales, publishing, speaking fees, and film and book rights.

For outsiders, including Western celebrities who have adopted the jailed women's cause, selling merchandise with the Pussy Riot logo is a way to raise money to help them.

Madonna has been one of their most vocal backers. She infuriated the Russian authorities by speaking out on behalf of the band at a concert in Moscow, performing with "Pussy Riot" written on her back in ink, and wearing one of the band's trademark ski masks. A Putin aide showed the Kremlin's disdain, calling her a "whore" on twitter.

The U.S. singer now offers Pussy Riot T-shirts for sale on her web site and at her concerts. She says she is sending the money she raises to help pay for the band's legal defense.

Samutsevich said she hadn't seen a penny and knew nothing of the details of the arrangement.

"Nobody agreed with me, Nadia or Masha," Samutsevich said, using affectionate names for Tolokonnikova and Alyokhina. "The only thing I can say is we will never sell T-shirts with our images on them. It's not us that's doing it."

She was trying to find out where proceeds from Madonna's sales were going, she said, adding that she would not be against it, as long as the cash is used to help "anyone who suffered from repressions as a result of their creative activity".

Madonna's spokeswoman, Liz Rosenberg, said the singer's staff had been "in direct contact with the jailed and free members of Pussy Riot" and insisted that Madonna had permission to sell the merchandise.

"I believe there is a dispute currently going on with different legal representatives which may account for some confusion," she said. "One hundred percent of the authorized merchandise on Pussy Riot that Madonna sells at her shows goes toward their legal fees and goes to wherever the members have asked it be sent to."

Icelandic singer Bjork also contacted Pussy Riot to discuss selling T-shirts to help raise money for legal fees, said her manager, Derek Birkett. Those discussions are on hold because band members "are now having second thoughts about the commercialization of the name and the idea", Birkett said.

REGISTRATION

Pussy Riot has always been more about protest than music. The band has never made any official recordings and does not have a recording contract.

Because its brand name isn't registered as a trademark, members have no control over who uses it. The band doesn't even have an official line-up: it says anyone can join. At any given moment it has 10-20 members.

"The brand is not registered, which means anyone can use the name. It has no copyright either, because it's not a product, not a song. And the name is so famous, it can really be used by anyone," said Taras Dzerkach, partner at German law firm Beiten Burkhardt.

While the band members were in jail, Tolokonnikova's lawyer, Mark Feigin, tried to register the Pussy Riot brand name with Russia's authorities as the property of a film company owned by his wife.

Tolokonnikova issued a statement denouncing the move from the prison colony where she is serving her sentence in Mordovia, 400 km (250 miles) southeast of Moscow.

"Stop the brand showdown! Stop the registration of the brand! Stop the madness," she said.

"I'm deeply disgusted by the financial and branding discussion. Money is dust. If someone needs it - take it... I need freedom, but not for me - for Russia."

Samutsevich told Reuters she was outraged when she found out what Feigin was up to.

"We only discussed copyright protection, but I did not know about brand registering. I trusted him (Feigin) completely... Now, I understand it was my mistake," said Samutsevich.

Feigin withdrew from Tolokonnikova's defense on Monday, saying the lawyers had become "irritants to the authorities" which was beginning to harm the women in jail.

In a blog post he defended his attempt to register the name Pussy Riot, saying he had done so solely to protect the interests of band members and had used his wife's company because there was no other company available.

Russia's intellectual property register Rospatent refused his application to register the brand anyway, giving no reason.

Meanwhile, Pussy Riot T-shirts are widely available in Russia from street sellers. You can buy them at shops in London's Camden Market or New York's Greenwich Village.

A variety of sellers are offering Pussy Riot shirts on websites like Amazon.com, some citing links to charities that say they are collecting money to help the band.

Artyom Loskutov, an artist from the city of Novosibirsk who sells Pussy Riot T-shirts online, said he had sent about 40,000 roubles ($1,300) in donations to the band, after selling about 400 shirts for a "minimum donation" of 800 roubles ($25) each.

He said he had been hounded by police, who charged him with offending Orthodox Russian Christians because of the shirts, which he now sells on the internet from a foreign-based site.

Regardless of where the cash goes, those who buy and wear the shirts are helping the band by showing support, he said.

"It's not just about money. When people wear them, they show their solidarity with these arrested women," he said. "People who go to protests and hold placards also go to work or to the cinema in these shirts and show their support this way." ($1 = 31.4452 Russian roubles)

Locked-out Lundqvist finally finds game to play

NEW YORK (AP) ? Henrik Lundqvist finally found a game to play.

It won't be under the bright lights of Madison Square Garden or in front of a hostile crowd in Philadelphia. But it will be meaningful and rewarding in a unique way.

Like players and fans all across North America and the world, the New York Rangers goalie misses the NHL. Lundqvist has run the gamut of emotions as the long lockout lingers. His thirst to get back on the ice will be quenched Saturday night ? however briefly ? as he joins other hockey stars in giving back to people who were ravaged by Hurricane Sandy.

Lundqvist will step on the ice in storm-damaged Atlantic City, N.J., along with Rangers teammates and foes from the Flyers and other teams to join forces in lending a helping hand to those recovering from the devastation.

Turkeys: Some people eat them, some feed them

LOS ANGELES (AP) ? Turkeys: Main course or animal companion?

OK, so it isn't even close. According to the industry group National Turkey Federation, more than 46 million of the big birds will be served as Thanksgiving dinner this year. Just a few hundred will get to experience the holiday as a pet, said turkey rescue Farm Sanctuary.

"I believe they make amazing companions, but they are different than cats or dogs," said Susie Coston of Watkins Glen, N.Y. For one thing, turkeys get too hot and are too messy to come indoors, said Coston, the national shelter director for the Farm Sanctuary.

Taking the large bird on as a companion requires more responsibilities than owning a dog or a cat, experts say. "If people are adopting domesticated turkeys, they should be aware that it's not a simple endeavor and would take a considerable amount of work," said NTF spokeswoman Kimmon Williams.

"Turkeys as pets is a complicated question," she added.

Like other animals that serve as companions to humans, turkeys come in different breeds, with some weighing as much as 60 pounds, Williams said. Every turkey has its own personality ? and some can be aggressive, she said.

Most pet turkey owners agree the birds aren't the kind of pets that can be walked on a leash or dressed for the Christmas family photo.

Coston said, for instance, that she wouldn't sleep with her turkey "like I do my dogs and cats. But I don't love dogs more than I do pigs or dogs and cats more than chickens and turkeys. I have a different relationship with each of them."

"Turkeys are inherently nervous and do not tend to be warm and cuddly. Turkeys also need plenty of space to run around in and be fed the appropriate diet," Williams noted.

Still, Karen Oeh, who will be getting four pet turkeys just before Thanksgiving, said she preferred them over dogs.

"Dogs are needy to me. They need affection, attention, security, they always need you to do something for them. With the turkeys, I don't feel guilty because I didn't take them to the park and throw the Frisbee," said the Ben Lomond, Calif., resident.

Despite their differences, turkeys and traditional pets share traits such as the ability to love unconditionally, loyalty and intelligence, owners said. Dr. Drucilla Roberts, a pathologist from Millis, Mass., pointed out a bonus: "They give us manure and eggs."

"I was always told that turkeys were the dumbest of farm animals. But that's not true. They know us and protect us. If a stranger comes, the turkey is right in his face and clucking and raising its feathers. They make great noises," Roberts said.

Like dogs, some turkeys grow attached to their owners. Oeh recounted how her last turkey, Ariala, followed her around the garden.

"She would stay by my right leg. When I was picking vegetables, she ate out of my hand. She let me pet her and kiss her," Oeh said, adding that petting turkeys can put them into a trance-like state. "She was so immersed in the moment that if you got tired of petting her and moved away, she'd wake up and look around as if to say 'What's going on?'"

The part-time teacher and student services coordinator had to put Ariala to sleep last year due to her health problems, for which Oeh discovered a lack of available information. Through trial and error, she learned that it's hard to give a turkey a pill or take them on trips, because crating them requires giving them bear hugs to keep their wings from flapping.

Experts and owners, however, are aware of at least one problem: owing to their large breasts, commercial turkeys have little balance and can fall easily. One of Roberts' turkeys, Turks, had to be put down after its weight caused a split sternum, she said.

Commercial turkeys are usually the ones that get adopted as pets: Coston said most turkeys rescued by the Farm Sanctuary come from factory farms and have been debeaked, detoed and fattened. Many arrive as victims of neglect, cruelty or hoarding; they fall off farm trucks; or they mysteriously show up in boxes on doorsteps, she said.

The sanctuary, which has locations in California and in New York, places about 50 turkeys a year and has found homes for more than 1,500 birds since it started 26 years ago, Coston said. Hundreds of other birds, including the weakest or those with special needs are not adopted out because the rescues can deal with their problems easier than adopters can, Coston said.

Such sanctuaries are the final stop for the most well-known turkeys to escape the dinner table: the annual National Thanksgiving Turkey (and an understudy), who are pardoned the night before the holiday. After much fanfare and a White House ceremony, this year's turkeys will live on George Washington's Mount Vernon estate in Virginia, with last year's birds, Liberty and Peace.

Karen Dawn, an author from Los Angeles, gets two turkeys every year and socializes them before they move on. This year's birds are going to live in Malibu.

They arrive stinky, so she gives them a bath and blow dry. "They relax like this is the best day they have had so far," said Dawn, who wrote "Thanking the Monkey: Rethinking the Way We Treat Animals."

Turkeys make great outdoor pets and "make better pets than other birds that you have to keep in a cage indoors," she said.

Dawn said her two 20-pound turkeys will be at her Thanksgiving dinner ? but as guests. Rosie and Martha will greet two dozen human guests in the garden and watch the sun set over the Pacific Ocean, while Dawn serves up Wild Turkey bourbon ? and tofurkey.

Keys To Success: Good Mental Health - Diet and Weight Loss Forums

Success in business and life is about the journey. What is the journey? First of all it is about our health. Most of the time people focus on physical health and ignore or downplay their mental health.
To experience small business success and the life you desire you must be aware of the state of your mental health. Most of us know inspirational stories of people who succeeded against overwhelming odds.
Mental Health Keys
What was their key to success? There were a couple of things. First, they understood that the quality of their lives seldom exceeds their personal development.
Secondly, because they were involved in personal development, they were always doing something positive which encouraged good mental health. Their minds became a highly developed muscle that carried them past their physical limitations to success. Helen Keller is one that comes immediately to mind. She was deaf and blind. Dr. Stephen Hawking, the renowned physicist is another.
Mental Health vs. Physical Health
Now let's look at the other side. How many inspirational stories do you know of where someone succeeded and overcame great challenges yet had poor mental health and excellent physical health? I can't think of any at the moment.
It was once said that what the mind can conceive and believe it can achieve. Yes, your mental health is the key to growth and satisfaction.
How do you achieve good mental health? There are many ways. Some of the more obvious include associating with positive people, affirming ourselves with our self-talk in a positive manner, participating in things that bring us satisfaction and enjoyment and avoiding negative media.
You become what you think about most. What are you thinking about? All of us sail the same stormy seas of life. Whether you are a self-employed business owner, entrepreneur or solo professional the challenges of running a small business can create waves that can come crashing over us may, at times, seem insurmountable.
Physical health is important to success. Yet, if you don't have the mental health even if you are healthy physically, you will hold yourself back.

Mental Health-Conceive Victory and See Yourself Winning
How do you sail through the huge waves that are trying to knock you off course? Begin with your mind.
Conceive your picture of success or victory. As a personal business coach I ask all my clients to get a clear picture of what success looks like for them not just for today but for five or ten years from now.
Get a clear picture in your mind of what success in the future will look like. Once the future is finished in your mind, what you need to do in the present becomes absolutely clear.
Start believing that you will achieve it. Small business growth and small business success as well as personal growth and success are engines that are run on the steam of belief.
Mental Health-Surround Yourself With Positive People
Another important point is that you must surround yourself with positive people. Also, positive self-talk to create an expectation of success is a must. And, watch good TV or read good books. China to unveil new communist leaders

BEIJING (Reuters) - China's ruling Communist Party unveiled its new leadership line-up on Thursday to steer the world's second-largest economy for the next five years, with Vice President Xi Jinping taking over from outgoing President Hu Jintao as party chief.

Xi was also named head of the party's Central Military Commission, state news agency Xinhua said.

The other new members of the Politburo Standing Committee - the innermost circle of power in China's authoritarian government - include premier-in-waiting Li Keqiang and financial guru Wang Qishan, who will be in charge of fighting corruption.

The number of members has been reduced to seven from nine, as expected, which should help ease consensus-building as they tackle everything from growing social unrest to uncertainty in the domestic and global economy.

North Korean-trained economist Zhang Dejiang is expected to head the largely rubber-stamp parliament, while Shanghai party boss Yu Zhengsheng is likely to head parliament's advisory body, according to the order in which their names were announced.

Tianjin party chief Zhang Gaoli and Liu Yunshan, a conservative who has kept domestic media on a tight leash, make up the rest of the group.

Xi will take over Hu's state position in March at the annual meeting of parliament, when Li will succeed Premier Wen Jiabao.

However, Guangdong's reform-minded party boss Wang Yang did not make it to the Standing Committee.

Advocates of reform are pressing Xi to cut back the privileges of state-owned firms, make it easier for rural migrants to settle in cities, fix a fiscal system that encourages local governments to live off land expropriations and, above all, tether the powers of a state that they say risks suffocating growth and fanning discontent.

With growing public anger and unrest over everything from corruption to environmental degradation, there may also be cautious efforts to answer calls for more political reform, though nobody seriously expects a move towards full democracy.

The party could introduce experimental measures to broaden inner-party democracy - in other words, encouraging greater debate within the party - but stability remains a top concern and one-party rule will be safeguarded.

Woman who drove on sidewalk holds 'idiot' sign

CLEVELAND (AP) ? A Cleveland woman puffed on a cigarette, wore headphones, and ignored passers-by and crowds of reporters as she stood for an hour Tuesday under a judge's order holding a sign that said, "Only an idiot would drive on the sidewalk to avoid a school bus."

A Municipal Court judge had ordered 32-year-old Shena Hardin to serve the highly public sentence Tuesday and Wednesday for the Sept. 11 citation after she was caught on camera driving on a sidewalk to pass a Cleveland school bus that was unloading children.

She arrived bundled up against the 34-degree cold at the intersection near downtown Cleveland as passing vehicles honked. Satellite TV trucks streamed the event live.

Hardin refused to comment, as did her mother, who watched from a parked car. A message seeking comment was left for Hardin's attorneys.

Hardin's license was suspended for 30 days and she was ordered to pay $250 in court costs.

Lisa Kelley, whose 9-year-old daughter boards the bus that Hardin had been passing on the sidewalk, said the sentence fit the crime.

"She's an idiot, just like her sign says," Kelley said as she watched Hardin lean against a fence, her head down and her eyes hidden by dark glasses.

"She did this almost every day last year," Kelley said. "She won't stop laughing. She's not remorseful, she laughed at every court appearance. She's still laughing, so she needs to be humiliated like this."

Kelley said she was only sorry the woman was standing in the cold and not the rain or snow.

Bill Lipold, 37, who works nearby in the blue-collar neighborhood of older homes and factories, yelled to Hardin: "Why do you hate kids?" He hopes the punishment works.

"How else are you going to stop her from doing it again?" he said. "She really didn't show remorse for her action after being caught, so you've got to try something."

With two schools located within two blocks of the location and busy commuter traffic, the area can be risky for youngsters walking to class, Lipold said.
