Chinese court upholds fine against dissident Ai Weiwei

BEIJING (Reuters) - A Chinese court upheld a $2.4 million tax evasion fine against China's most famous dissident Ai Weiwei on Thursday, in a case that has badly tarnished the country's already poor human rights reputation.

"It's an extremely shameless court," Ai, whose 81-day detention last year sparked an international outcry, told reporters.

"It didn't respect the facts or give us a chance to defend ourselves; it has no regard for taxpayers' rights," he said, adding he did not know whether now he had to pay to entire fine though he suspected he did.

Ai, 55, had asked the Chaoyang District Court to overturn the city tax office's rejection of his appeal against the 15 million yuan ($2.38 million) tax evasion penalty imposed on the company he works for, Beijing Fake Cultural Development Ltd, which produces his art and designs.

"From the Fake tax case (we) can see that there's no fair justice in China," Ai added.

The case is widely seen by activists as an attempt to muzzle the outspoken artist, who has repeatedly criticized the Chinese government for flouting the rule of law and the rights of citizens.

Courts, controlled by the ruling Communist Party, rarely accept lawsuits filed by dissidents and appeals against official decisions are routinely dismissed.

The case comes on the heels of a score of other high-profile cases, including the fleeing to the U.S. embassy of blind, self-taught legal activist Chen Guangcheng.

Government efforts to silence Ai have frequently backfired, as demonstrated by an outpouring of public sympathy - and cash - in response to the tax penalty.

About 30,000 people donated money to help Ai cover an 8.45 million yuan bond required to contest the tax charges. Many of Ai's supporters folded money into paper planes that were flown over the walls of his home.

Indonesian ferry collides with cargo ship; 8 dead

JAKARTA, Indonesia (AP) ? A passenger ferry collided with a cargo ship and sank west of Indonesia's main island Wednesday morning, and at least eight people were killed, officials said.

More than 200 crew and passengers were evacuated after the accident, said Transportation Ministry spokesman Bambang Ervan, who initially said the second vessel was an oil tanker. It wasn't immediately clear if all of them were OK, and a search for others is in progress where the accident occurred in the Sunda straits, west of Java island.

"So far it's still unclear how many passengers were on board the ferry," Ervan said, adding it had about 30 crew members. "We are still waiting for the manifest."

Manifests are often unreliable in Indonesia because tickets are sold onboard to passengers who are never registered.

A helicopter and at least 10 ships were searching for survivors, said Gagah Prakoso, a spokesman for the National Search and Rescue Agency.

The Bahuga Jaya ferry links Java and southern Sumatra island. It went down after colliding with the South African-flagged Norr Gastar about six kilometers (four miles) off Bakahuni port in Sumatra.

There was no immediate word on whether the cargo ship was damaged.

Ferries are a major source of transportation in Indonesia, the world's largest archipelago nation, with more than 17,000 islands and a population of 240 million. Sea accidents are common due to overcrowding and poor safety standards.

Hospital systems in Hampton Roads are joining a nationwide trend towards wellness and prevention ? starting with their employees. Many organizations have hired wellness coordinators, provided free fitness programs for employees and thrown in financial perks for those who agree to fill out risk assessments or work with a health coach.

Bon Secours Hampton Roads is one of the local systems leading the way in employee wellness initiatives with at least one huge financial incentive: bringing down the costs of employee health care.

At Bon Secours a variety of employee wellness initiatives are being used to help record, track, and improve changes in employee health throughout the three hospital system. Among them is the no-nicotine hiring policy started Nov. 30, 2011. A ?Rethink Your Drink? campaign reduced the size of sugary beverages served in the hospital cafeterias and incorporated healthier drinks like coconut water this year. An on-site clinic for employees will open at Bon Secours Maryview Medical Center in Portsmouth next month. With help from the weight loss and nutrition experts at Bon Secours In Motion clinics, Bon Secours also launched a free 13-week fitness program this summer called ?Team Lean,? which helps selected employees work to lose weight and live healthier with personal training sessions and nutrition education.

Some deadly breast cancers share genetic features with ovarian tumors

ScienceDaily (Sep. 23, 2012) ? The most comprehensive analysis yet of breast cancer shows that one of the most deadly subtypes is genetically more similar to ovarian tumors than to other breast cancers.

The findings, published online Sept. 23 in Nature, suggest that most basal-like breast tumors and ovarian tumors have similar genetic origins and potentially could be treated with the same drugs, says the study's co-leader Matthew J. Ellis, MD, PhD, the Anheuser-Busch Chair in Medical Oncology at Washington University School of Medicine in St. Louis. The other co-leader is Charles M. Perou, PhD, at the University of North Carolina.

Basal-like tumors account for about 10 percent of all breast cancers and disproportionately affect younger women and those who are African-American.

The new research is part of The Cancer Genome Atlas project, which brings together leading genetic sequencing centers, including The Genome Institute at Washington University, to identify and catalog mutations involved in many common cancers. The effort is funded by the National Institutes of Health (NIH).

"With this study, we're one giant step closer to understanding the genetic origins of the four major subtypes of breast cancer," says Ellis, who treats breast cancer patients at the Siteman Cancer Center at Barnes-Jewish Hospital and Washington University. "Now, we can investigate which drugs work best for patients based on the genetic profiles of their tumors. For basal-like breast tumors, it's clear they are genetically more similar to ovarian tumors than to other breast cancers. Whether they can be treated the same way is an intriguing possibility that needs to be explored."

Currently, for example, basal-like breast tumors often are treated like many other breast cancers, using anthracycline-based chemotherapy. But another of Ellis's studies recently showed that women with basal-like tumors don't benefit from these drugs, which also have severe side effects. At the very least, he says, the new data indicates that clinical trials should be designed to avoid the use of these drugs in basal-like tumors.

As part of the new research, a nationwide consortium of researchers analyzed tumors from 825 women with breast cancer. The scientists used six different technologies to examine subsets of the tumors for defects in DNA, RNA (a close chemical cousin of DNA) and proteins. Nearly 350 tumors were analyzed using all six technologies.

"By tying together those different data sets, we can build a story around the biology of each breast cancer subtype that is dictated by the genome, interpreted by the RNA and played out by the proteins at work inside each tumor," says co-author Elaine Mardis, PhD, co-director of The Genome Institute. "These data can serve as a backdrop for other questions about how particular mutations affect survival or response to certain drugs."

The study confirmed the existence of four main subtypes of breast cancer: Luminal A, luminal B, HER2 and basal-like. The latter includes most triple-negative breast tumors, so-named because they lack receptors for the hormones estrogen, progesterone or human epidermal growth factor 2 (HER2). These tumors often are aggressive and do not respond to therapies that target hormone receptors or to standard chemotherapies.

Across the four subtypes, mutations in only three genes -- TP53, PIK3CA and GATA3 -- occurred in more than 10 percent of patients' tumors. But, the scientists found unique genetic and molecular signatures within each of the subtypes. Their findings add to the growing body of evidence suggesting that tumors should be cataloged and treated based on the genes that are disrupted rather than the location in the body.

In general, compared to the other subtypes, basal-like and HER2 tumors had the highest mutation rates but the shortest list of significantly mutated genes. These genes are thought to be major drivers of cancer progression. For example, 80 percent of basal-like tumors had mutations in the TP53 gene, which have been linked to poor outcomes. About 20 percent of the tumors also had inherited mutations in BRCA1 or BRCA2 genes, which are known to increase the risk of breast and ovarian cancer.

"This suggests that it only takes a few hits to key genes that drive cancer growth," Mardis explains.

A high frequency of TP53 mutations also occurs in ovarian cancer, the researchers noted. Overall, the genetic profiles of basal-like and ovarian tumors were strikingly similar, with widespread genomic instability and mutations occurring at similar frequencies and in similar genes.

Finding new drug targets for basal-like breast tumors is critical, and the research suggests that patients with mutations in the BRCA genes may benefit from PARP inhibitors or platinum-based chemotherapy, which are already used to treat ovarian cancer.

By comparison, luminal cancers (which include estrogen receptor-positive and progesterone-receptor positive tumors) had the lowest mutation frequencies and longer lists of significantly mutated genes. This suggests defects in multiple genetic pathways can lead to the development of luminal breast cancers.

Most patients with luminal A cancer have good outcomes, and the most common mutation in that subtype occurred in PIK3CA, which was present in 45 percent of tumors. TP53 mutations only occurred in 12 percent.

Some patients with luminal B tumors do well but many experience recurrence years after treatment. Interestingly, the most common mutations in these tumors occurred in TP53 (linked to poor outcomes) and PIK3CA (linked to good outcomes), which may explain the disparate results seen in patients with this subtype.

"Now, we're much closer to understanding the true origins of the different types of breast cancer," Ellis says. "With this information, physicians and scientists can look at their own samples to correlate patients' tumor profiles with treatment response and overall outcomes. That's the challenge for the future -- translating a patient's genetic profile into new treatment strategies."

Fontana mayor supports school district recall campaign

FONTANA - An effort to recall two School Board members has gained an ally - the mayor.

"I'm all in," said Aquanetta Warren, using the same phrase she used when she announced she would run for mayor.

"I have been getting so many telephone calls and e-mails from people in the community about what's going on at the School Board ... if I am going to lead this community, it's my job to get those two on the ballot (of a recall election) and let the people decide."

Warren was referring to the recall effort against Fontana Unified School District board members Leticia Garcia and Sophia Green.

Both Fontana Unified board members were served paperwork in July notifying them of a recall effort, but the campaign has been relatively low-profile since.

Backers of the effort cite the opposition of Green and Garcia to a city-run after-school program they say serves 3,500 students and provides more than 350 jobs.

But they also listed several other grievances in their petition filing in July.

Among those was Garcia's vote last year to eliminate all the district's counselors in budget-cutting move.

Their claims also include that Garcia spearheaded a failed parcel tax during one of the worst economic times since the Great Depression, and the $147,000 cost of the special election came at a time when programs and jobs were being eliminated.

"I am not concerned with the recall effort," Garcia said. "Even if they get

the (required) signatures - and I don't think they will - I can defeat this at the election."

The election would be held in spring next year.

Garcia said the parcel tax was an effort to find revenues for the district, and while it was unsuccessful it was supported by more than 50 percent of the voters, she said. But that type of election required the measure to win by a two-thirds majority, she said.

Since the parcel tax failed, she said, other districts have moved toward their own parcel tax elections to raise revenues.

As for the counselors, it was a recommendation brought to the board by the district's superintendent, she said.

Warren said a major reason for her decision to take a leadership role in the recall effort is that for several weeks, Garcia and Green have been, from her viewpoint, stepping up efforts to oust Superintendent Cali Olsen-Binks.

During the public comment session at Wednesday's School Board meeting, Warren asked for people to help her with the recall effort, a request which drew a reprimand from the board's attorney.

The next day, Garcia alleged in an interview that Warren violated the California Education Code and other laws with her request for help.

Warren said that other speakers, at previous board meetings, have discussed the recall in statements to the board - and were allowed to continue.

Garcia said she wrote a letter asking the San Bernardino County District Attorney's office to take action.

Warren said that since Wednesday night's board meeting she has raised about $30,000 for the recall campaign, which needs to collect 7,905 valid signatures for each board member by Jan. 30 in order for the effort to advance to a special election.

Warren and Garcia have exchanged words on several issues, the most significant rift being over criticism of the city-run after-school program for the district.

At one point, when Garcia began pushing to have that service provided by another organization, Warren stood outside the district's board meeting room vowing, "This is war."

Garcia has said that as an elected official, she has a right to question district practices, and that includes programs with the city of Fontana.

Green frequently aligns with Garcia on issues before the board, and joined Garcia in her questioning of the quality of the city-run after-school program.

Green could not be reached for comment Friday.

Garcia has said that election would cost the district about $200,000 - money better spent on education-related activities.

Catheryne Caveed, 23, was in line at a Verizon store in the Queens borough of New York. An iPhone 4 user, she had no regrets about skipping last year's model, the iPhone 4S. The only real upgrade in the 4S, she said, was Siri, the voice-controlled "personal assistant."

"The 4S looked the same as the 4," Caveed said. With the 5, "everything is different ? even the headphones."

Apple's stock closed up $1.39, or 0.2 percent, at $700.09. The stock surpassed the $700 level for the first time earlier this week, as excitement for the launch mounted.

For Apple, the iPhone introduction is the biggest revenue driver of the year. Analysts expect the company to sell millions of phones in the first few days. This spring, iPhone sales slowed down from their historical growth rates, apparently because potential buyers were holding off for the arrival of the "5."

Apple now needs to sell tens of millions of phones before the end of the year to justify its position as the world's most valuable public company. Although Samsung Electronics Inc. of Korea sells more smartphones, Apple's iPhone profits are far greater.

In London, some shoppers had camped out for a week in a queue that snaked around the block. In Hong Kong, the first customers were greeted by staff cheering, clapping, chanting "iPhone 5! iPhone 5!" and high-fiving them as they were escorted one-by-one through the front door.

The smartphone went on sale in the U.S. and Canada hours after its launch in Australia, Japan, Hong Kong, Singapore, Britain, France and Germany. It will launch in 22 more countries next week. The iPhone 5 is thinner, lighter, has a taller screen, faster processor, updated software and can work on faster "fourth generation" mobile networks.

The handset has become a hot seller despite a new map app that early users have deemed inferior to Google Maps, the software it replaces. In a sign of the intense demand, police in Osaka, Japan, were investigating the theft of nearly 200 iPhones 5s, including 116 from one shop alone, Kyodo News reported. In London, police sought help finding a man wanted in connection with the theft of 252 iPhone 5s from a shop in Wimbledon early Friday morning.

Analysts have estimated Apple will ship as many as 10 million of the new iPhones by the end of September.

Some fans went to extremes to be among the first buyers by arriving at Apple's flagship stores day ahead of the release.

In downtown Sydney, Todd Foot, 24, showed up three days early to nab the coveted first spot. He spent about 18 hours a day in a folding chair, catching a few hours' sleep each night in a tent on the sidewalk.

Foot's dedication was largely a marketing stunt, however. He writes product reviews for a technology website that will give away the phone after Foot reviews it.

"I just want to get the phone so I can feel it, compare it and put it on our website," he said while slumped in his chair.

In Paris, the phone launch was accompanied by a workers' protest ? a couple dozen former and current Apple employees demonstrated peacefully to demand better work benefits. Some decried what they called Apple's transformation from an offbeat company into a multinational powerhouse.

But the protesters ? urged by a small labor union to demonstrate at Apple stores around France ? were far outnumbered by lines of would-be buyers on the sidewalk outside the store near the city's gilded opera house.

Not everyone lining up at the various Apple stores was an enthusiast, though. In Hong Kong, university student Kevin Wong, waiting to buy a black 16 gigabyte model for 5,588 Hong Kong dollars ($720), said he was getting one "for the cash." He planned to immediately resell it to one of the numerous grey market retailers catering to mainland Chinese buyers. China is one of Apple's fastest growing markets but a release date for the iPhone 5 there has not yet been set.

Wong was required to give his local identity card number when he signed up for his iPhone on Apple's website. The requirement prevents purchases by tourists including mainland Chinese, who have a reputation for scooping up high-end goods on trips to Hong Kong because there's no sales tax and because of the strength of China's currency. A similar money-making strategy was being pursued in London, where many in the crowds ? largely from the city's extensive Asian community ? planned to either send the phones to family and friends back home as gifts or sell them in countries where they are much more expensive.

"It makes a really nice gift to family back home," said Muhammad Alum, 30, a minicab driver from Bangladesh. "It will be two or three weeks before there is a SIM card there that can work it, but it's coming soon."

Others who had waited overnight said the iPhones cost roughly twice as much in India as in Britain, making them very welcome as gifts.

Tokyo's glitzy downtown Ginza district not only had a long line in front of the Apple store, but another across the main intersection at Softbank, the first carrier in Japan to offer iPhones.

Hidetoshi Nakamura, a 25-year-old auto engineer, said he's an Apple fan because it's an innovator.

"I love Apple," he said, standing near the end of a two-block-long line, reading a book and listening to music on his iPod.

"It's only the iPhone for me."

Hello

I remember at school, being encouraged to be creative. ?In between Maths, Science and Geography came Art, Textiles and Home Economics. ?In between writing essays and analysing newspaper articles for English came creative writing. ?I have been working for many years now, and every now and then something comes along and I am suddenly able to be creative and I love it. ?At the moment my organisation is trying to look at new ways of doing things, and adopting a Kaizen philosophy and culture ? I am helping some people put together a quarterly Kaizen ?Bulletin? for our department to promote Kaizen, share current initiatives under way, and the other day I got some ideas about how to help make it an appealing document that people will want to read, click on links and for it to be colourful and appealing. ?One of the other guys started suggesting we add webcasts and other fancy things to it, and suddenly we were being creative. ?We work in a financial organisation, and to be able to play with pictures and graphics and colour was so refreshing. ?I even found myself playing with it at home ? and I generally avoid bringing work home at all costs!

Toastmasters has allowed me to be a little more creative, too, as my speech topics are really up to me. ?It has had my brain working in a different way, and all this recent creativity has reminded me how much I enjoy creative writing. ?I remembered bragging to my Mum that I would write a novel some day, as she read her Mills & Boon romances I scoffed and said ?I could write one of those?. ?Me, with very little romance in my life at the time, such arrogance! ?But it has my brain buzzing a little lately, remembering that brag ? that I would write and potentially be published some day.

Creativity, creative dreams ? I enjoy my hobbies, and that monster I knitted recently was done without a pattern. ?But I struggle for ideas much of the time, when I try to force creativity ? I love to write and scribble and draw but none of it is taken seriously by me. ?I wonder what is waiting to be hatched inside my brain?

Maybe I?m just listening to too much The Trouble with Templeton ?

(AP) ? The heavily armed extremists who laid siege to the U.S. Consulate in Libya used military-style tactics that may have steered Americans toward a waiting ambush, U.S. officials said Friday as they pieced together details about how the compound was overrun.

U.S. intelligence indicates that 50 or more people, many of them masked, were responsible for the Sept. 11 assault on the U.S. diplomatic mission in Benghazi. Gun trucks provided added firepower. The attackers set up a perimeter, controlling access in and out of the compound. A first wave of attacks sent the Americans fleeing to a fallback building, where a second group of extremists beset them with precise mortar fire.

Intelligence reports were still coming in, but officials told The Associated Press that what may have initially seemed like a protest over an anti-Islam movie that had spun out of control now showed the hallmarks of a more sophisticated operation.

In a country coming off a civil war, a level of battlefield savvy does not prove the attack on the compound was planned well in advance. How much planning went into the operation and whether it could have been detected or prevented remain unanswered questions, officials said.

The attacks killed Ambassador Chris Stevens, diplomat Sean Smith and two former Navy SEALs, who U.S. officials said were security officers guarding diplomatic officials. Stevens was visiting Benghazi from Tripoli to preside over the opening of an "American Space" cultural center.

The officials spoke on condition of anonymity because they were not authorized to discuss intelligence reports. They stressed that even now authorities do not have a clear understanding of exactly what happened in Benghazi. FBI agents from New York and Washington were in Libya investigating the attack.

"What happened in Benghazi was a terrorist attack," Secretary of State Hillary Clinton said Friday. "And we will not rest until we have tracked down and brought to justice the terrorists who murdered four Americans."

Officials have not singled out one responsible group, but have focused their attention on Ansar al-Shariah, a Libyan militant group led by a former detainee at the U.S. military-run prison in Guantanamo Bay, Cuba.

Since the civil war that ousted Libyan dictator Moammar Gadhafi last year, the country has been awash with rebels, militias and terrorists. Weaponry is easy to come by, both from the former regime, from weapons depots looted during the war, and from foreign powers that armed the rebellion. The origin of the weapons used in the assault on the U.S. compound was unclear, officials said.

Whether the attack was premeditated carries both political and intelligence significance.

From an intelligence standpoint, the longer an operation was in the works ahead of the attack, the more the U.S. government will face scrutiny for not anticipating and preparing for it.

Politically, Republicans have accused President Barack Obama's administration of misreading the assault as an outgrowth of Middle East demonstrations over an American-made Internet video insulting the Islamic prophet Muhammad. They have also criticized the protection of the consulate, particularly since the attack fell on the anniversary of the Sept. 11, 2001, terrorist attacks, a date when authorities are normally on alert for attacks.

White House spokesman Jay Carney has said there was no evidence the attack was premeditated. Obama has said extremists used the protests as an excuse to attack.

A spontaneous protest that turns violent is harder to predict and respond to.

"The intelligence agencies are still not confident enough to represent to us whether it was planned in advance or taking the opportunity of a spontaneous protest," Rep. Adam Schiff, D-Calif., said Friday.

Investigators say some of the people involved have a "hodgepodge of affiliations with multiple militant groups," making it hard to hold one particular militia or movement responsible, said a senior U.S. intelligence official, speaking anonymously because he was not authorized to be quoted publicly describing the investigation.

Wanis al-Sharef, who was Libya's deputy interior minister until he was fired after the attacks, said a small group of lightly armed gunmen were the first to gather outside the compound. They were then joined by a crowd of civilians protesting the film. Finally, a larger group of heavily armed men arrived with gun vehicles and grenade launchers. That final group was responsible for the siege.

Ansar al-Shariah has repeatedly denied being any part of the attack, but eyewitnesses and security officials said the group's militiamen were among the gunmen who joined the demonstration outside the compound. The group claimed its fighters were only in the Benghazi area providing security at Jalaa Hospital. But that's more than three miles from the U.S. compound, which lies on the outskirts of the city in a rural area.

One witness said he was detained by Ansar al-Shariah members during the protest because he was taking pictures of one of their leaders.

Whoever they were, the attackers stormed the main building and set it on fire. One U.S. official described the militants striking the front of the building first, distracting security, while a second group struck then from the rear. Many people escaped and fled to an annex to the east.

About an hour after the assault began, American and Libyan forces retook control of the compound and brought everyone to the annex. Rescue teams headed their way.

Intelligence indicates the gunmen broke off into teams to block certain roads away from the compound, officials said. Whether that changed the route or otherwise influenced how the Americans moved through the streets remains unclear, but one U.S. official said the tactic was being looked at as an indication of battlefield strategy and sophistication.

As the Americans waited to be rescued from the annex, that building came under mortar fire. Mortars are short-range bombs that launch in high arcs. Aiming them can be a matter of trial and error. But U.S. officials said mortars were landing directly on the roof of the annex.

That, officials said, indicated an experienced fighter, a well-planned assault or both.

New Yorkers grumble over Macy's makeover

A $400 million makeover is giving New York's iconic Macy's store a sleek, new 21st-century style.

And some preservationists aren't happy about it. They see the overhaul of America's biggest department store as scrapping classic Beaux Arts and Art Deco touches in favor of the latest trend in retail design ? something like an Apple computer store.?

"Macy's has Apple fever," said Theodore Grunewald, a New York preservation activist. "Everyone is jealous of Apple, and thinks the secret to the company's success is this beautiful, elegant minimalist design vocabulary they have. But this is about protection of our heritage."

Macy's reconstruction, to be completed in 2015, will add 100,000 square feet to the 1.1 million square feet of existing retail space.

Floor-to-ceiling fabric shrouds areas under renovation. But some sections already have been finished, including the world's largest women's shoe department, which offers 280,000 pairs of shoes ? several thousand displayed in white settings.

Macy's spokeswoman Elina Kazan gushes that the store will be a "spectacular place to shop at an iconic New York City destination."

About 20 million shoppers a year visit Ohio-based Macy's flagship store. The building has nine floors of retail space and covers nearly an entire city block, from West 34th Street to West 35th Street, between Seventh Avenue and Broadway.

It is best known as home of the annual Macy's Thanksgiving Day Parade and as the setting that inspired the beloved 1947 Christmas film, "Miracle on 34th Street."

Originally constructed in 1902 in the Beaux Arts style, it was expanded in the 1930s with plenty of Art Deco details. Most noticeable was a jazzy, geometric coating of marble, encasing more than 100 columns that soar to the ceilings.

Grunewald said the columns will now be simplified, losing the marble and the ornamental toppings that give the space "its pizazz."?
While Macy's has been on the National Register of Historic Places since 1978, it has not been given landmark designation, allowing its owners to make architectural changes.

"I was stunned they were doing this, making it look like everywhere else in America when they have a little treasure here," said preservationist Christabel Gough of the Society for the Architecture of the City.

Macy's officials said it was premature to compare the renovation to Apple since it is still a work in progress. They said, too, that the plan actually revives some of the building's distinctive features.

Originally, the interior street floor "was one great retail hall, and Macy's asked us to bring it back as one grand space," said Jay Valgora, chief architect for the renovation. "Macy's asked us to bring back the grandeur of the original store, and whenever there's true historic fabric, to restore it."

Also, the original, ornate entrance on 34th Street will return, and some huge old windows that were painted over have been opened again, lighting a new chocolate-and-champagne cafe. Forty-two of the store's original wooden escalators will stay.?

Valgora said the old and the new Macy's will "complement each other" in the same light-filled venue.

"I like it ? how organized and open it is," said Rosie Pina, a Manhattan schoolteacher. "Change is good."

Brian Williams, a sports club technician from Queens, joked, "I'm a male, and I don't really care how it looks when I'm shopping."

But standing by the jewelry area near some aging, cream-colored pillars and looking over at a gleaming, snow-white new section, he added: "I like the older better ? it feels warmer, more at home."

Report: Alleged Lohan victim's account questioned

Update (10 p.m. ET): Hours after actress Lindsay Lohan was arrested in New York for allegedly striking a pedestrian with her SUV, officials familiar with the case are questioning the pedestrian's account, NBC 4 New York reported Wednesday night.

Law enforcement officials were waiting on the man's medical records to determine whether he was actually struck by the vehicle, the station reported.

A law enforcement source who has seen the surveillance video of the incident told NBC 4 New York the footage shows the right bumper of Lohan's SUV either brushing the pedestrian or completely missing him. After Lohan passed him, the video shows the man running after her, yelling.

A law enforcement official told NBC 4 New York there was no indication Lohan was intoxicated or had been drinking.

It doesn't get any easier for Lindsay Lohan: The "Liz & Dick" actress was arrested early Wednesday morning in New York for "leaving the scene of an accident and causing physical injury," a spokesperson with the New York Police Department told NBC News.

According to the spokesperson, Lohan, 26,?was driving a 2010 Porsche SUV down an alley on the west side of Manhattan, heading to the Dream Hotel, when she struck a pedestrian while traveling at a low speed.

The NYPD spokesperson said Lohan went into the hotel on West 16th Street after the accident and was arrested after she came out at 2:30 a.m. Lohan was booked, issued a desk appearance ticket and released without bail.

TMZ reports that alcohol was not involved. The 34-year-old pedestrian was injured in the knee and taken to Bellevue Hospital where he was in stable condition, Reuters reported.

"While some of the facts are still being gathered, it appears that this is much ado about nothing," Lohan's publicist Steve Honig said in a statement. "We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue."

Though she was released from formal probation in March of this year after being charged in 2007 with drunk driving and cocaine possession, the actress remains on informal probation until 2014 in connection with the theft of jewelry in 2011. According to Access Hollywood, the L.A. City Attorney's office has forwarded information about the incident to the relevant authorities. It's unclear if Lohan will be charged with a violation of probation.
